Restrictive covenants can be in effect a form of private planning control: they are restrictions on the development or use of land. Planning permission can be granted, yet a restrictive covenant can stop you constructing the very building you have planning permission for.

Some are very simple and are meant only to protect a neighbourhood from homeowners destroying things such as trees or historic things or otherwise directly harming property values. Some can go further such as restricting the property (land) to a single private dwelling or require permission for any additional buildings

There are different approaches that can be taken to resolving these, but be aware the order is critical. There various approaches such as Indemnity Policies; Lands Tribunal; and contacting those who have the benefit of the covenant. 

We have used all three options and our decision on what route to take has been based on the merits of each site and the wording of each covenant.
